Welcome to Afarose. These Terms of Use, together with any policies referenced in these Terms, govern your access to and use of afarose.com, including any content, features, products, services, tools, and online shopping experiences offered through the website.

Throughout these Terms, “Afarose,” “we,” “us,” and “our” refer to Han Hsuan International LLC, doing business as Afarose, the operator of this website, and its affiliated entities, representatives, employees, contractors, service providers, and partners where applicable. “You” and “your” refer to any person who accesses, browses, uses, creates an account on, or places an order through the website.

By accessing or using this website, creating an account, placing an order, participating in the Try-at-Home Program, submitting content, or otherwise using any part of the website, you agree to be bound by these Terms of Use and all policies referenced herein. If you do not agree to these Terms, please do not access or use this website.

These Terms incorporate by reference our other policies, including but not limited to our Return Policy, Try-at-Home Program Policy, Shipping Policy, Payment Policy, Privacy Policy, and any other policies, notices, or terms posted on the website.

We may update, change, or replace any part of these Terms at any time by posting the revised Terms on this page. Your continued use of the website after changes are posted means you accept the updated Terms. It is your responsibility to review this page periodically for updates.

ONLINE STORE TERMS

By using this website, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have given consent for your minor dependent to use this website.

You may not use our website, products, content, services, or tools for any unlawful, fraudulent, harmful, abusive, or unauthorized purpose. You understand that information you submit through the website, other than payment card information, may be transferred over various networks and may be changed to conform and adapt to technical requirements of connecting networks or devices. Payment card information is handled through secure third-party payment processors and is encrypted during transmission where required by applicable standards.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, scrape, crawl, or otherwise misuse any portion of the website, use of the website, access to the website, or any content, product information, pricing, images, copy, data, or contact information displayed on the website without our express written permission.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect the meaning of these Terms.

ACCOUNTS AND CUSTOMER INFORMATION

You may be able to create an account or check out as a guest. If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account.

You agree to provide current, complete, and accurate information when creating an account, placing an order, submitting measurements, requesting returns, participating in Try-at-Home, or communicating with customer service.

You are responsible for keeping your account information, email address, shipping address, billing address, phone number, measurements, and payment information accurate and up to date.

Afarose is not responsible for delays, failed delivery, misdelivery, order errors, sizing issues, payment issues, or customer service delays caused by inaccurate, incomplete, outdated, or misleading information provided by you.

PRODUCTS AND SERVICES

Certain products or services may be available exclusively online through the website. Product availability, sizing, colors, customization options, sample availability, prices, promotions, and shipping eligibility may change at any time without notice.

We make reasonable efforts to display product colors, images, fabrics, details, descriptions, measurements, and pricing as accurately as possible. However, we cannot guarantee that your device, monitor, screen, photography, lighting, or browser will display colors or details accurately.

Color, fabric, dye lot, trim, beading, lace, embellishment, structure, fit, and other product details may vary slightly due to production methods, fabric characteristics, screen display differences, and normal variations in made-to-order garments.

Many Afarose dresses are made to order. Production times, delivery estimates, and availability may vary depending on the style, fabric availability, customization, order volume, carrier conditions, and other factors.

We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.

Any offer for any product or service made on this website is void where prohibited by law.

STANDARD SIZE, CUSTOM SIZE, AND MEASUREMENTS

Standard-size dresses are made according to the Afarose Size Chart. If your measurements do not match one size exactly, you are responsible for choosing the size that best fits your measurements or contacting customer service for guidance before placing your order.

Custom-size dresses are made based on the measurements you provide. Custom sizing may help reduce the need for major alterations, but it does not guarantee a perfect fit. Minor alterations may still be needed depending on body shape, posture, shoes, undergarments, personal fit preference, and the nature of the garment.

Custom-size dresses and customized orders are final sale and cannot be returned or exchanged, except where required by law or expressly approved by Afarose in writing.

Because each dress is cut, sewn, and finished by hand, a measurement tolerance of approximately 0.5 to 1 inch may apply. This tolerance is normal for made-to-order garments and does not necessarily mean the item is defective.

You are responsible for reviewing our Size Chart and Measurement Guide before placing an order.

PRICING, PROMOTIONS, AND AVAILABILITY

Prices for our products and services are subject to change without notice.

We reserve the right to modify or discontinue any product, service, promotion, discount, offer, sample program, or website feature at any time without notice.

Promotional codes, discounts, and special offers may be subject to expiration dates, product exclusions, minimum purchase requirements, usage limits, and other restrictions. Promotional codes must be applied at checkout before the order is placed. We cannot guarantee that a promotion can be applied after checkout is complete.

We reserve the right to cancel, refuse, or adjust any order involving pricing errors, promotion errors, system errors, inventory errors, or suspected misuse of promotions or discount codes.

ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We make reasonable efforts to keep information on the website accurate and up to date. However, information on the website may contain typographical errors, inaccuracies, omissions, outdated details, or incomplete information relating to product descriptions, measurements, pricing, promotions, shipping fees, transit times, availability, policies, or other content.

We are not responsible if information made available on the website is not accurate, complete, or current. The material on this website is provided for general information only and should not be relied upon as the sole basis for making purchasing decisions without reviewing current product details, checkout information, and applicable policies.

We reserve the right to correct errors, inaccuracies, or omissions, update information, change pricing, revise policies, or cancel orders at any time without prior notice, including after an order has been submitted.

Historical information on this website may not be current and is provided for reference only. You agree that it is your responsibility to monitor changes to the website and applicable policies.

ORDERS, BILLING, AND PAYMENT

By placing an order, you agree to provide current, complete, and accurate billing, shipping, payment, and account information.

You authorize Afarose and our third-party payment processors to charge your selected payment method for the order total, including product prices, taxes, shipping fees, rush fees, Shipping Adjustment Fees, Try-at-Home sample fees, customization fees, and any other applicable fees shown at checkout or authorized under our policies.

For most orders, your payment method will be charged when you place your order. Certain payment methods may show a pending authorization before the charge is fully processed. Pending authorizations are controlled by your bank or payment provider.

We reserve the right to refuse, cancel, or limit any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per account, per payment method, per billing address, or per shipping address.

We may cancel or restrict orders that appear to be placed by dealers, resellers, distributors, automated purchasing tools, or customers engaging in suspicious, abusive, fraudulent, or inconsistent activity.

If we change or cancel an order, we may attempt to notify you using the email address, billing address, phone number, or other contact information provided at the time the order was placed.

ORDER CHANGES AND CANCELLATIONS

Order changes and cancellations are subject to the applicable policy for the order type.

Made-to-order dresses and accessories may be canceled or changed within 72 hours of placing the order, subject to approval and production status.

Ready-to-ship items, swatches, sample orders, and clearance items may only be canceled or changed within 30 minutes of placing the order.

Once an order has entered production, processing, packing, or shipment, changes and cancellations may no longer be available.

Additional charges may apply for approved order changes, including but not limited to rush fees, Shipping Adjustment Fees, expedited shipping fees, customization fees, size or style change fees, price differences, and reshipping fees.

SHIPPING AND DELIVERY

Shipping and delivery are subject to our Shipping Policy.

Production time and shipping transit time are separate. Many Afarose dresses require production time before they are shipped.

Delivery estimates are not guaranteed unless expressly stated in writing by Afarose. Delays may occur due to production status, carrier delays, weather, holidays, high order volume, address issues, customer unavailability, customs or regional delivery restrictions, or other circumstances outside our reasonable control.

Afarose is not responsible for packages that are delayed, lost, stolen, misdelivered, returned, or marked as delivered by the carrier when the shipping address provided at checkout was correct and the package was shipped according to the order details.

You are responsible for providing a complete and accurate shipping address at checkout. Additional shipping or handling fees may apply if a package is returned, refused, undeliverable, rerouted, or reshipped.

RETURNS, REFUNDS, AND EXCHANGES

Returns and refunds are subject to our Return Policy.

Eligible standard-size dresses and eligible accessories may be returned only if they meet all return requirements and are returned within the applicable return window.

Returned items must be unworn, unwashed, unaltered, undamaged, clean, free of stains, odors, pet hair, makeup, deodorant marks, and signs of wear, with all original tags attached.

Final sale items are not eligible for return, exchange, refund, store credit, or cancellation after the applicable cancellation window has passed, except where required by law or expressly approved by Afarose in writing.

Original shipping fees, rush fees, Shipping Adjustment Fees, oversized-box charges, reshipping fees, and other non-product fees are non-refundable unless otherwise required by law or expressly approved by Afarose.

Afarose does not currently offer exchanges. If an item is eligible for return, you may submit a return request and place a new order for the item you want. New orders are subject to current pricing, promotions, availability, and production timelines.

TRY-AT-HOME PROGRAM

Participation in the Try-at-Home Program is subject to our Try-at-Home Program Policy.

Try-at-Home sample dresses are provided for temporary indoor try-on purposes only. They are not rentals for weddings, events, parties, photoshoots, fittings outside the home, commercial use, resale, or any other purpose.

Sample dresses remain Afarose property and must be returned within the required return window and in acceptable condition.

By placing a Try-at-Home order, you authorize Afarose to charge the payment method on file for applicable sample fees, late charges, replacement costs, damage charges, missing item charges, shipping charges, handling charges, and any other amounts permitted under the Try-at-Home Program Policy.

Afarose may limit, refuse, cancel, or restrict Try-at-Home orders or future purchasing privileges if a customer does not comply with the Try-at-Home Program Policy.

GIFT CARDS AND STORE CREDIT

Afarose gift cards and store credit may be used only for eligible purchases on the Afarose website, unless otherwise stated.

Gift cards and store credit cannot be redeemed for cash except where required by law.

Gift cards and store credit cannot be used to purchase additional gift cards.

If an order paid with a gift card or store credit is returned and approved for refund, the refund may be issued back to a new gift card, store credit, or the original payment method, depending on the original payment method and Afarose’s refund process.

Afarose is not responsible for lost, stolen, deleted, misplaced, or unauthorized use of gift cards or store credit codes.

OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, payment processors, shipping carriers, analytics providers, advertising partners, review platforms, social media features, appointment tools, or other third-party services over which we do not have full control.

You acknowledge and agree that such tools and services may be provided “as is” and “as available” without warranties, representations, or conditions of any kind from Afarose.

Your use of third-party tools or services may be subject to the terms, policies, and practices of those third parties. You should review those terms carefully before using any third-party tool or service.

Afarose is not responsible for any harm, loss, delay, error, charge, data issue, or other damage arising from your use of third-party tools or services.

THIRD-PARTY LINKS

The website may include links to third-party websites, products, services, or content that are not owned or controlled by Afarose.

We are not responsible for reviewing, monitoring, evaluating, or guaranteeing the accuracy, safety, legality, availability, or content of third-party websites or services.

We are not liable for any harm, loss, damage, charge, or dispute related to your use of third-party websites, products, services, resources, content, or transactions. Questions or complaints regarding third-party products or services should be directed to the third party.

INTELLECTUAL PROPERTY

All content on the website, including but not limited to text, product descriptions, images, photographs, videos, graphics, logos, icons, designs, layouts, software, product names, style names, and other materials, is owned by or licensed to Afarose and is protected by intellectual property and other applicable laws.

You may use the website only for personal, non-commercial shopping and informational purposes. You may not copy, reproduce, distribute, modify, publish, display, transmit, sell, resell, exploit, scrape, or create derivative works from any website content without our express written permission.

Unauthorized use of our intellectual property may violate copyright, trademark, privacy, publicity, unfair competition, and other laws.

USER COMMENTS, REVIEWS, PHOTOS, FEEDBACK, AND OTHER SUBMISSIONS

If you submit, upload, send, tag, post, email, or otherwise provide reviews, comments, photos, videos, testimonials, feedback, ideas, suggestions, measurements, questions, survey responses, social media content, or other materials to Afarose or through the website, you are responsible for the content you submit.

You represent and warrant that you own or have the necessary rights and permissions to submit the content, and that your content does not violate the rights of any third party, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights.

By submitting content to Afarose, you grant Afarose a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, edit, crop, adapt, translate, create derivative works from, and otherwise use the content in connection with our website, marketing, advertising, social media, email, customer service, product development, and business operations.

This license does not transfer ownership of your content to Afarose. However, it allows us to use the content for the purposes described above without compensation to you, unless otherwise agreed in writing.

We are under no obligation to maintain any submission in confidence, pay compensation for any submission, publish any submission, or respond to any submission.

We may, but have no obligation to, monitor, edit, reject, remove, or disable content that we determine, in our sole discretion, is unlawful, offensive, threatening, abusive, defamatory, obscene, misleading, infringing, harmful, or otherwise objectionable, or that violates these Terms.

You may not use a false email address, impersonate another person, misrepresent your identity, or mislead Afarose or third parties as to the origin of any content.

Afarose takes no responsibility and assumes no liability for content submitted by you or any third party.

PERSONAL INFORMATION AND PRIVACY

Your submission of personal information through the website is governed by our Privacy Policy.

By using the website, creating an account, placing an order, communicating with customer service, participating in Try-at-Home, submitting measurements, or otherwise providing information to Afarose, you acknowledge that we may collect, use, disclose, and process personal information as described in our Privacy Policy.

PROHIBITED USES

In addition to other prohibitions set forth in these Terms, you are prohibited from using the website, its content, or any services:

(a) for any unlawful, fraudulent, abusive, or unauthorized purpose; (b) to solicit others to perform or participate in unlawful acts; (c) to violate any international, federal, state, provincial, or local law, rule, regulation, or ordinance; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false, inaccurate, incomplete, or misleading information; (g) to upload or transmit viruses, malware, or malicious code; (h) to collect, track, scrape, or misuse the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, scrape, or use bots or automated tools; (j) for any obscene, abusive, exploitative, or harmful purpose; (k) to interfere with or circumvent the security features of the website or any related service; (l) to place orders using stolen, unauthorized, or fraudulent payment methods; (m) to abuse return, refund, gift card, promotion, or Try-at-Home policies; or (n) to resell products without authorization.

We reserve the right to terminate or restrict your use of the website or services for violating any prohibited use.

DISCLAIMER OF WARRANTIES

We do not guarantee, represent, or warrant that your use of the website or services will be uninterrupted, timely, secure, error-free, accurate, complete, or reliable.

You agree that we may remove, suspend, modify, or discontinue the website or services for indefinite periods of time or cancel the website or services at any time, without notice.

Your use of the website, services, and products is at your own risk. Except as expressly stated by Afarose in writing, the website, services, content, products, and materials provided through the website are provided “as is” and “as available,” without warranties, representations, or conditions of any kind, whether express or implied.

To the fullest extent permitted by applicable law, Afarose disclaims all warranties and conditions, express or implied, including but not limited to implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, non-infringement, accuracy, availability, and error-free operation.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Han Hsuan International LLC, doing business as Afarose, and its owners, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, licensors, and partners shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, consequential, exemplary, or similar damages of any kind.

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, business interruption, emotional distress, loss of opportunity, or any similar damages, whether based in contract, tort, negligence, strict liability, warranty, statute, or otherwise, arising from your use of the website, inability to use the website, purchase or use of any product, participation in any service or program, reliance on website content, shipping delay, carrier issue, product variation, policy enforcement, or any other claim related in any way to your use of the website or products.

Because some states or jurisdictions do not allow the exclusion or limitation of certain damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

INDEMNIFICATION

(a) your breach of these Terms or any policy incorporated by reference; (b) your violation of any law or regulation; (c) your violation of the rights of any third party; (d) your misuse of the website, products, services, promotions, gift cards, returns, or Try-at-Home Program; (e) information, measurements, content, or submissions you provide; or (f) any fraudulent, abusive, negligent, or unauthorized conduct by you.

GOVERNING LAW

These Terms and any disputes arising out of or relating to these Terms, the website, products, services, orders, policies, or your relationship with Afarose shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles, unless otherwise required by applicable law.

Nothing in these Terms is intended to limit any consumer rights that cannot be waived under applicable law.

SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and such determination shall not affect the validity and enforceability of the remaining provisions.

TERMINATION

These Terms remain effective unless and until terminated by either you or Afarose.

You may terminate these Terms at any time by ceasing to use the website.

If, in our sole judgment, you fail or we suspect that you have failed to comply with any term or provision of these Terms, we may terminate or restrict your access to the website or services at any time without notice. You will remain liable for all amounts due up to and including the date of termination.

The obligations and liabilities incurred before termination shall survive termination for all purposes.

ENTIRE AGREEMENT

These Terms, together with any policies or operating rules posted by Afarose on the website or incorporated by reference, constitute the entire agreement and understanding between you and Afarose regarding your use of the website and services.

These Terms supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Afarose regarding the website and services.

Any failure by Afarose to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
